Thank you for choosing Sugar Sweet Cookies & Treats

These terms and conditions serve as the contract between the customer and Sugar Sweet Cookies & Treats. By paying the invoice, the customer is agreeing to these terms and conditions.

Please take a few minutes to review these Terms and Conditions. Your purchase of products from us constitutes your agreement to follow these Terms and Conditions and to be bound by them.

Sugar Sweet Cookies & Treats reserves the right to update or modify these Terms and Conditions at any time without prior notice. For this reason, we encourage you to review these Terms and Conditions whenever you purchase products from us or use our Website.

Payments

You pay, I'll bake!  Payment is required upfront so that I can source your cute cutters, spectacular sprinkles, fabulous food colors, and the perfect packaging.  Your payment will reserve your pick-up/delivery date too!

Terms of Pickup/Delivery

Because of the fragile nature of our products, some breakage may occur during transport but will not affect the taste and quality of our treats.  Local deliveries are based on available times. We ask for a three-hour window in which the recipient will be available to accept the order. Since our products are perishable and made to order, a recipient is required to be present to accept the item(s). Refunds will not be issued for deliveries with incomplete or incorrect information or if the recipient is not present to receive the order.

For deliveries to hotel rooms, concierges, and bell desks:

Concierges and bell desks will rarely accept perishable food items on the behalf of a customer. If you have received authorization, please include the full name of the employee who has verified that they will accept the item(s) on the recipient's behalf. For deliveries directly to a recipient's room, we must have the reservation name and room number (hotels are not able to give us this information) and the recipient must be available in the room to accept the item(s). We are not able to enter a room while the guest is not there.

For deliveries to an office:

Please keep in mind the recipient's personal schedule and the department we are to deliver to.

For deliveries to a home:

Please keep in mind the recipient's personal schedule and possible gate codes (if needed).

For deliveries to a restaurant:

We will require the name and time of the reservation.

Shipping

Shipping is not available due to MN Cottage Food Law restrictions.  All orders must be picked up or delivered in person.

Variations in design

-While Sugar Sweet Cookies & Treats will make every effort to provide exactly the flavor, filling, decoration, size, color, shape, and design discussed during consultations, custom orders are an art form and may be subject to variations.
- If the customer supplies an image or likeness to be created, Sugar Sweet Cookies & Treats will make every attempt to make the item as close to the likeness as possible. If the product requires equipment or ingredients that cannot be obtained within the time allotted (exotic flavors, molds, shapes, stamps, texture, additional novelty such as glitter), the closest resemblance available will be used to complete the product.
- Color matching is not a precise science and different sugar substrates take color differently. Sugar Sweet Cookies & Treats will do everything possible to make substrates match to each other and to match provided color swatches, but sometimes it is not possible to make a 100% perfect color match and some colors are just not achievable using food-grade dyes.
- Sugar Sweet Cookies & Treats cannot match a “verbal” color or a color sent via an electronic device, as all monitors display color differently. To attempt a color match, you must provide a color swatch 14 days in advance of the event.
- To maintain stability and the integrity of your event item(s), Sugar Sweet Cookies & Treats reserves the right to make design and structural changes to your item(s) on-site or off, without prior notification.

Sole Provider

For reputation management and food safety reasons, all items for your event must be supplied by Sugar Sweet Cookies & Treats. If any dessert item(s) is provided by an individual or company other than Sugar Sweet Cookies & Treats without prior notification and our express written consent, we reserve the right to leave your venue without setting up your item(s), and all payments made will be forfeited. The undelivered items will be disposed of at Sugar Sweet Cookies & Treat’s discretion.

Site and Venue Conditions

Sugar Sweet Cookies & Treats reserves the right to refuse set up of items in any location that is not properly air-conditioned or weatherproofed or on any plateau or stand that does not appear sturdy enough to hold the weight of our items. All efforts will be made to work with venue staff to find placement better suited for your item(s) to make sure it looks beautiful on your arrival.

-Cakes are heavy and require a perfectly level and sturdy table and cake plateau/stand. Sugar Sweet Cookies & Treats is not responsible for any damage caused by tables or cake plateaus/stands that are unable to withstand the weight of our cakes or improperly installed or installed at a lean.
-Once cakes are set up, they are not intended to be moved until served. Sugar Sweet Cookies & Treats is not responsible for damage caused by others after the cake is set up by Sugar Sweet Cookies & Treats.

Equipment Rental

All equipment rental prices include a rental fee and a deposit. If the rented items are returned to Sugar Sweet Cookies & Treats within 3 days, the deposit will be returned to the customer. If the item is not returned within 3 days, the customer forfeits the deposit. If shipping the items back to Sugar Sweet Cookies & Treats, the customer will have 5 business days and must provide a shipping tracking number via email when shipped.

Rights and Waiver

- Sugar Sweet Cookies & Treats reserves the right to take photos of the product for display or promotion without the customer's consent.
- Sugar Sweet Cookies & Treats is not responsible for any damage to item(s) after pick-up/delivery/set-up is complete. Most items are heavy and require a climate-controlled environment (at or below 75 degrees). 
- If flowers are provided by an outside source, the arrangement of the flowers will be included in the price. It is acknowledged by Sugar Sweet Cookies & Treats and the customer that fresh flowers are not a food product. They may contain pesticides, dirt, insects, and other contaminants. 
- If the customer elects to pick up the order, the customer is responsible for the item(s) as soon as it leaves Sugar Sweet Cookies & Treats premises. Upon visual inspection of the item(s) and its departure from the premises, the customer approves the item(s) visual appearance and waives any rights to a refund based on the style, design, or visual appearance of the item(s). 
- Sugar Sweet Cookies & Treats is not a nut-free, dairy-free, soy-free, or wheat-free bakery.  While some items may be free of these ingredients, all products have the chance of sharing the air with sister ingredients, and anyone highly allergic should take caution when consuming our products.  The customer is responsible for notifying their guests.  Sugar Sweet Cookies & Treats is not responsible for any adverse effects or allergic reactions. 
- Upon the event of a natural disaster, accident or other situation outside of Sugar Sweet Cookies & Treats control, this contract may be voided.
- Sugar Sweet Cookies & Treats will endeavor to perform its services in a professional manner and provide the best customer experience possible. If our products or services do not meet our high standards, or the client is dissatisfied, we may--at our discretion--provide the amount paid for those products and services in the form of a refund. Sugar Sweet Cookies & Treats total liability is hereby limited to amounts paid to Sugar Sweet Cookies & Treats for its goods and services. Sugar Sweet Cookies & Treats will not be liable for any special, incidental, punitive, or consequential damages, whether foreseen or unforeseen, regardless of whether liability is based on breach of contract, breach of an express or implied warranty, negligence, strict liability, tort, or otherwise. 
- Only items, actions, and dessert details explicitly listed in the invoice are guaranteed by Sugar Sweet Cookies & Treats. 

Changes

Decisions are tough!  But we are here to help.  Order changes can be made up to two weeks from your scheduled pick-up/delivery date for all custom orders.  After that, all change requests will be under consideration and a small fee will apply.  Seasonal items may incur an additional charge or may be substituted if unavailable.

Cancellations

To avoid any charges, orders cannot be canceled less than two weeks prior to scheduled pickup/delivery time.  All other cancellations are subject to a 10% cancellation fee.  Note: NO refunds will be given for orders that have already been made. 

Refund and Return Policy

If there is a problem with an order you've received, please call (612) 229-9105 or email us at sugarsweetcookiesandtreats@gmail.com. Any issues with an order must be reported within 24 hours of when the item(s) were received. There are no returns or exchanges.

Please Note

Sugar Sweet Cookies & Treats is a Registered Cottage Food Producer with the MN Department of Agriculture.  These products are homemade and not subject to state inspection.
